Terms of Service
Last updated August 24, 2026
Agreement to these terms
These Terms of Service govern your use of the Swish Robotics website, the Swish appliance, the Swish mobile application, and any related services. By reserving, purchasing, or using any of them, you agree to these terms. If you do not agree, do not use the services.
We may update these terms. If a change is material we will give notice on this page or by email before it takes effect. Continuing to use the services after that means you accept the revised terms.
Who we are
Swish Robotics is a company based in San Francisco, California. You can reach us at info@swishrobotics.com.
[REVIEW] Add the registered legal entity name, company number, and a postal address for formal notices.
Eligibility and accounts
You must be at least 18 and able to enter a binding contract. You are responsible for the accuracy of the information on your account and for keeping your credentials secure. Tell us promptly at info@swishrobotics.com if you believe your account has been used without your permission.
Reservations and pre-orders
A reservation holds your place in the production queue. It is not a completed sale, and placing one does not transfer ownership of any unit to you.
We do not charge the purchase price until your unit ships.
You may cancel a reservation at any time before it ships, and any amount you have paid is refunded in full. See the Refund Policy.
Estimated ship windows are estimates, not guarantees.
Specifications, features, and pricing may change before shipment. If a change is material and adverse to you, we will tell you and you may cancel for a full refund.
Prices, payment and taxes
Prices are shown in US dollars and exclude taxes and shipping unless stated. Promotional pricing, including early-bird pricing, applies only while offered and may require conditions we describe at the time. You authorise us and our payment processor to charge your chosen payment method for amounts you owe.
[REVIEW] Confirm the sales-tax and shipping jurisdictions you intend to serve.
Using the Swish
Swish is a cooking appliance intended for ordinary household use. It applies heat and moves parts, and it must be operated according to the product manual and safety instructions.
Do not modify the appliance or use it with parts we have not supplied or approved.
Do not leave it operating in a way the manual tells you not to.
Follow the food safety guidance we provide. You are responsible for the ingredients you load and for confirming that a meal is safe for whoever will eat it, including allergens.
The appliance is not intended for commercial food production. [REVIEW] Confirm whether commercial use should be prohibited outright.
Meal plans and subscriptions
Meal plans renew automatically for the interval you selected until you cancel. We charge at the start of each interval using your payment method on file.
You can cancel or skip in your account before the weekly cut-off shown at checkout. Changes after the cut-off apply to the following delivery.
Deliveries need someone able to receive perishable goods. We are not responsible for food left unattended after a completed delivery.
Menus vary with availability and we may substitute comparable items.
SwishAI and connected features
Some features depend on Wi-Fi, our servers, and third-party services, and require the appliance to send data to us. Those features may change or be interrupted, and we do not guarantee uninterrupted availability. SwishAI produces suggestions, not professional advice — it is not nutritional, medical, or dietary advice, and you should not rely on it as such.
How data from the appliance is handled is described in the Privacy Policy.
Software licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Swish software and firmware for operating your own appliance. You may not copy, sell, sublicense, reverse-engineer, or attempt to extract source code from it, except where the law expressly permits. We may deliver updates automatically, including updates that change or remove features.
Content you submit
You keep ownership of recipes, photographs, and other content you submit. By submitting it you grant us a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and adapt it for operating and promoting the services. You confirm you have the rights to grant that licence. We may remove content at our discretion.
Acceptable use
Do not use the services to break the law, infringe anyone’s rights, interfere with or probe our systems, scrape them, resell access, or misrepresent your identity or your relationship with us.
Our intellectual property
The Swish name, logo, product designs, software, and site content are owned by us or our licensors. These terms do not transfer any of that to you.
Warranty and disclaimers
Hardware is covered by the limited warranty described in the Refund Policy. Beyond that warranty and anything the law requires, the services are provided “as is” and “as available”, without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the services is limited to the amount you paid us in the twelve months before the claim arose.
[REVIEW] A liability cap and its exclusions are exactly the clauses a court will scrutinise. Have counsel set these.
Indemnity
You agree to indemnify us against claims, losses, and reasonable costs arising from your misuse of the services, your breach of these terms, or content you submit.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Before starting formal proceedings, contact us at info@swishrobotics.com so we can try to resolve the matter informally.
[REVIEW] Decide whether to require arbitration and include a class-action waiver. Both have significant consequences and specific drafting and disclosure requirements.
